1. About ProfileCodes

ProfileCodes is a digital identity and payments platform operated by Profile Code, a regulated entity in Kenya since 2019, registered under Business Registration Number BN-5XCM9VM. Our physical offices are at Mirage Towers, Waiyaki Way, Nairobi, Kenya. You may contact us at info@profilecodes.com or by phone at +254 700 454424.

By creating an account or using the Service in any way, you agree to these Terms of Service in full. If you do not agree, please do not use the Service.

2. The Service

ProfileCodes provides the following features and capabilities:

• A unique ProfileCode that serves as your digital identity address
• A public profile card accessible via profilecodes.com/profile/[your code]
• QR code and NFC tap card sharing
• Social links aggregation and vCard contact saving
• Status updates displayed on your public profile
• Anonymous messaging — receive messages without revealing the sender's identity
• Payment collection — accept payments, gifts and donations via your ProfileCode
• Profile view analytics and WhatsApp notifications
• Contact capture — allow visitors to leave their contact details on your public profile via the Leave your contact feature
• Subscription-based premium features (Pro and Elite plans)

Features vary by subscription plan. We may add, modify, or discontinue features at any time with reasonable notice.

3. Eligibility and accounts

• You must be at least 18 years old to use this Service
• You must provide accurate, complete, and current information when registering
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity that occurs under your account
• One person may not maintain more than one free account
• You must notify us immediately of any unauthorised use of your account

4. ProfileCodes (your code)

Free plan users are assigned a system-generated ProfileCode. Pro plan users may regenerate their code once. Elite plan users may set and change a custom ProfileCode, subject to availability and our acceptable use policy. We reserve the right to reclaim or reassign codes that violate our acceptable use policy, infringe third-party rights, or remain inactive for more than 12 consecutive months on the free plan.

5. Payment collection feature

ProfileCodes enables users to receive payments, gifts and donations through their public profile page. By enabling this feature, you acknowledge and agree that:

• Payment processing is handled by Paystack under their own terms and conditions
• You must connect a valid bank account to receive funds
• ProfileCodes does not hold, control, or take custody of any funds at any time
• Settlement of funds to your bank account is subject to Paystack's settlement schedule (typically T+2 business days)
• Transaction fees apply as disclosed at the time of setup
• You are responsible for all taxes and regulatory obligations arising from payments received
• ProfileCodes is not liable for failed, delayed, or disputed transactions
• Payment intents (Pay, Gift, Donate) are indicative only and do not create any legal obligation between sender and recipient

6. Anonymous messaging

The anonymous messaging feature allows visitors to send messages to a profile owner without revealing their identity. By using this feature you agree that:

• Senders may not use anonymous messaging to harass, threaten, defame, or harm any person
• Senders may not send spam, unsolicited commercial messages, or illegal content
• We log sender IP address hashes for abuse prevention — we do not store full IP addresses
• We may disclose sender information to law enforcement if required by applicable law
• Profile owners may disable anonymous messaging at any time from their dashboard
• We rate-limit messages to prevent abuse

7. WhatsApp notifications

ProfileCodes may send WhatsApp messages to your registered phone number for the following purposes: profile view alerts, payment received confirmations, anonymous message alerts, and account verification codes (OTP). By registering a phone number, you consent to receiving these notifications. You may opt out by removing your phone number from your profile or contacting support. WhatsApp messaging is subject to Meta's terms of service.

8. Subscriptions and billing

• Pro and Elite subscriptions are billed monthly and renew automatically
• Subscription payments are processed by Paystack, PayPal, or PawaPay depending on your location and preferred payment method
• Pricing is displayed in your local currency at checkout, based on your geographic location
• Refunds are considered on a case-by-case basis — contact us at info@profilecodes.com within 7 days of a charge
• Downgrading takes effect at the end of your current billing period
• We reserve the right to change pricing with at least 30 days' written notice
• Non-payment will result in automatic downgrade to the free plan

9. Acceptable use

You agree not to use ProfileCodes to:

• Impersonate any person, entity, or brand without authorisation
• Post false, misleading, or fraudulent information on your profile
• Violate any applicable local, national, or international law or regulation
• Attempt to gain unauthorised access to the Service or other user accounts
• Upload or distribute malicious code, viruses, or harmful content
• Use the anonymous messaging feature to harass or harm others
• Use the payment feature for money laundering, fraud, or any illegal transaction
• Scrape, crawl, or extract data from the platform without written permission
• Resell or sublicense access to the Service

10. Your content

You retain ownership of all content you post on ProfileCodes, including your profile information, photo, bio, and links. By posting content, you grant ProfileCodes a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content solely as part of operating the Service. You are solely responsible for ensuring your content is accurate, lawful, and does not infringe any third-party rights.

11. Intellectual property

The ProfileCodes name, logo, platform design, and proprietary features are owned by Profile Code. You may not copy, reproduce, or create derivative works from any part of the platform without prior written consent. Your ProfileCode, your profile content, and your data remain yours.

12. Termination

We may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or cause harm to other users or to the platform. You may delete your account at any time from your dashboard settings. Upon termination, your ProfileCode URL will stop resolving within 24 hours and your data will be deleted in accordance with our Privacy Policy.

13. Disclaimer of warranties

The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied. We do not guarantee uninterrupted, error-free, or secure operation of the platform. We are not responsible for the content of external websites linked from profiles.

14. Limitation of liability

To the maximum extent permitted by law, Profile Code shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising from your use of or inability to use the Service. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Kenya. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya. We encourage you to contact us first at info@profilecodes.com to resolve any dispute informally before pursuing legal action.

16. Changes to these terms

We may update these Terms at any time. We will notify users of material changes by email and by displaying a notice on the platform. Continued use of the Service after the effective date of changes constitutes your acceptance of the revised Terms.
